Updated Operations Credo and Spicer reports status

As was noted in the Commission’s status update of 29 April 2016, preparation of these reports has been affected by litigation, legislative changes and the need to ensure that those involved are afforded procedural fairness.

The existence of non publication orders by the courts since the commencement of the proceedings arising out of the Operation Jasper investigation has prevented the Commission from providing information to explain the further delay in the Operation Credo report.

As those orders have now been lifted, the Commission is now able to advise that it has been unable to progress the publication of the Operation Credo report owing to the criminal proceedings being conducted by the Director of Public Prosecutions (DPP) against Mr Edward Obeid and Mr Moses Obeid.

While those proceedings arise out of the Operations Cyrus and Jasper investigations, the Commission is of the view, in accordance with section 18 of the Independent Commission Against Corruption Act 1988, that the publication of the Operation Credo report during the currency of criminal proceedings may prejudice the right of the accused to a fair trial. Representations from the solicitors of the accused to that effect were conveyed to the Commission by the DPP.

As previously noted, the report arising out of Operation Spicer is under preparation and will be furnished to Parliament in due course.
